The American Chemistry Council (ACC) filed suit to halt California from listing BPA on a list of reproductive toxicants under Proposition 65. ACC says listing BPA would circumvent the state’s scientific process by allowing administrative staff to overturn a state scientific panel’s conclusions. In July 2009, the California Office of Environmental Health Hazard Assessment’s scientific panel (OEHHA), the Developmental and Reproductive Toxicant Identification Committee (DART-IC), concluded that BPA does not satisfy Prop 65’s listing criteria for developmental toxicants. That decision took into account a 2008 report from the National Toxicology Program that OEHHA now cites as the sole document to justify the decision to list BPA. ACC’s complaint was filed with Sacramento County Superior Court.
