The 9th US Circuit Court of Appeals has cleared the way for the EPA to review the registration of Enlist Duo, a Dow Agrosciences herbicide corn producers say it needed to control weeds. The National Corn Grower's Association (NCGA) said the appeals court chose to ask for a more robust review instead of denying the agency’s request to scrap or vacate the herbicide’s registration.

The association sees the ruling as “a cause for optimism,” since it said the court's decision “denies the requests both of the environmental groups who brought the suit and the EPA.” NCGA said it would continue working with the EPA as it moves forward in this process and on the approval of other pending herbicide resistant production systems.
